Charges have been dropped against the alleged instigator of a home invasion in Masury because the alleged victim did not come to court.
Two others arrested that day still face charges.
The incident occurred Aug. 20 on Ulp Street when the alleged victim reported that there were three men with guns in her house, Brookfield police said. Police arrived to find a man in the driveway and detained him and five adults and a child who were in the house.
According to witness statements given at the time, Thomas E. Roseboro used to live at the house and was unhappy with those now living there, and wanted to force them out, police said.
Police eventually arrested Roseboro, 38, of Masury; Jhalil A. Harrison, 41, of Sharon; and Christopher Augustine, 32, of Brooklyn, and charged them with aggravated menacing.
Harrison’s and Augustine’s cases were initially heard in Trumbull County Eastern District Court and were bound over to a grand jury. However, in Roseboro’s case, the failure of the alleged victim to show up for any court dates led to prosecutors stating that they could not proceed and the charges were dismissed.
Judge Marty Nosich set a show-cause hearing for Jan. 9 and ordered the alleged victim to appear and explain why she has not appeared in court. She did not show up for that hearing or a Jan. 23 contempt hearing and a warrant has been issued for her arrest.
Harrison also has been charged with possession of fentanyl and having a weapon while under disability because of a previous conviction that renders him unable to possess a firearm. Augustine also has been charged with having a weapon under disability.
